Proposed Florida Property Tax Amendment

On June 2nd and 3rd, the Legislature returned to Tallahassee for its sixth special Session of 2026. The focus of the Special Session was property tax reform. House Joint Resolution 1F proposes an amendment to the State Constitution (“Amendment 3”) that, if approved by 60 percent of voters or more in the General Electiom, would create a $250,000 homestead exemption for non-school ad valorem taxes. Future applicants for the homestead exemption will need to establish they were a permanent resident of Florida on December 31, 2026; otherwise, the applicant will receive historic $50,000 non-school homestead exemption for four years before the enhanced $250,000 homestead exemption begins. If approved by votes, Amendment 3 would also reduce the current 10% annual assessment limitation for nonhomestead properties to 5% annually. Amendment 3 proposes to limit local government uses of ad valorem tax revenue to listed “core services” contained in the proposal. Lastly, the Legislature approved Senate Bill 4F which adjusts local government calculations of the rolled back millage rate.
